How to File a Complaint Against Online Shopping Portals Upon Receiving a Fake Product?

Due to a lack of time and other factors, many individuals prefer to purchase online through numerous websites to take advantage of discounts. On the other hand, numerous internet shopping platforms engage in deceptive practices in order to defraud consumers and steal their hard-earned money. Furthermore, these shopping websites employ a variety of techniques to maximise profit from their customers by hook or crook.

The tempting offers and discounts on various products entice unsuspecting customers. These ruthless businessmen use deceptive commercial methods to deceive consumers about the true cost and quality of their items.

It is the most effective and deceptive approach used by today's internet enterprises to sell a variety of necessary products and gadgets at a reduced price. Consumers are easily duped by fraudulent shopping sites, resulting in emotional anguish and unwanted harassment as a result of purchasing low-quality products with no way of getting their money back.

The following are some examples of how customers have fallen victim to internet fraud:

  • Fake Website: Scammers create fake websites with similar logos and domain names that appear to be genuine. A fake website is set up on the internet in order to defraud customers.
  • A genuine site, false vendor: When a goods is faulty or fake, the seller or transportation firm is usually the one who commits the fraud.
  • Courier Company: The courier company is not to blame, neither the vendor nor the website. The person in control of the product, i.e. the logistics person, is sometimes in charge of product delivery.

To avoid becoming a victim of such online shopping scams, a customer might take the following precautions:

  • Check the site's Authenticity: The site's domain name must be verified. In other words, the URL should begin with "https" rather than "http" and include a lock icon
  • Check the vendor's rating: It is necessary to determine whether or not the seller has a good reputation. Before purchasing an item, a buyer should always read the customer's reviews and the seller's ratings
  • Secure Payment: Any payment made via net banking, credit card, or debit card should always be made over a secure payment channel

How do I file a consumer complaint against a fake product?

You can take the following legal steps against the vendor or online shopping website if you acquired a false or duplicate brand product:

Notify the Seller of the Fake Product: You must immediately contact the website's customer service department and inform them of the fake product's details and payment method. Every detail concerning the date and time of purchase, transaction id, payment id, email confirmation, and so on must be included in the complaint. It's possible that the seller will take some time to investigate the problem.

Issue a Legal Notice: If the seller does not take action despite being informed of the defective product, you can file a consumer complaint against the fake product and send a legal notice to the seller. A legal notice must be delivered after contacting a consumer court advocate who can design a fool-proof legal notice that covers the issue, the action desired, the seller's response, and the buyer's action necessary as a result of the notice.

File a case in consumer court: If the seller fails to take any action in response to the complaint, the buyer has the option of filing a consumer complaint in the appropriate consumer forum. The customer can employ a consumer case lawyer to sue the seller for damages.

Submit a copyright infringement case: In the case of a false or copycat product, the original brand can also file a copyright consumer complaint. The Copyright Act of 1957 allows for the filing of a copyright infringement case. A copyright lawyer can assist the original brand in launching a copyright infringement complaint in this situation.

Case Study:

When a Flipkart consumer from Chandigarh opened the package after ordering an iPhone 12 128 GB edition during the e-commerce platform's Big Billion Days deal, he received the shock of his life. Instead of the iPhone valued Rs 51,999, Simranpal Singh discovered two bars of Nirma soap inside. "Once the Flipkart Wishmaster (delivery person) arrived, I asked him to open the box and started recording the video," Singh said on his blog. The unboxing was documented in a video released to the 'GoAndroid' YouTube channel. Singh declined to provide the OTP with the delivery person after viewing the soap bars, claiming that doing so would imply that the order had been received. After that, the customer claimed he filed a complaint against the fake product with customer service. He said that the corporation acknowledged responsibility for the error and issued a refund within a few hours, which Flipkart confirmed. "The issue was resolved by the Flipkart support team and the whole amount was refunded within a span of a few days," Singh said.

What does Flipkart have to say about it?

When approached by The New Indian Express, a Flipkart spokeswoman said, "When it comes to events that jeopardise customer trust, Flipkart has a strict zero-tolerance policy. When the customer informed us of the mishap during the open box delivery, our Support Team reached out right away to confirm the information, and a full refund was issued. Since the occurrence, our staff has been in contact with the consumer, and we are currently conducting an internal investigation."

Conclusion:

If you buy any products from an e-commerce website and find out that they are faulty or fake you can raise your voice against the website. Connect with the website’s authority and if then also your problem is not taken care of, you can file a consumer complaint with the help of Online Legal India.
