Initially, such a kind of harassment was seen in failed marriages but with the advancement of time. IPC Section 498 gives valid ground for divorce to women to protect themselves from cruelty. It could be mental harassment/abuse or torture done by anybody in life.
We see how women are affected even in the workplace, where an employer or employee is found guilty of causing sexual or mental harassment towards any women. We also see how many celebrities came out in the open and had discussed their #MeToo issues which they have faced in their life.
From different case scenarios, cruelty seems to be always on the top as the most popular ground for divorce in India, whereas adultery comes just after it. However, Section 498 of the IPC Act is the governing law for mental torture in India amongst married couples. Don't tolerate any more by still being shut about the mental torture, fight against the unjust.
Harassment can occur in any form but let us see a few common types:
Below here are a few Indian laws that deal with various forms of Harassment:
1. The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.
2. Indian Penal Code, 1860.
The term "Mental Harassment" has not been specifically defined under the Indian Penal Code, 1860 (IPC). However, harassment can be interpreted in terms of cruelty or torture. The relevant sections are as follows: –
A. Section 294: Obscene acts and songs:
B. Section 354: Assault or criminal force to woman with intent to outrage her modesty.-
C. Section 354A: Sexual harassment and punishment for sexual harassment.
D. Section 498A: Husband or relative of husband of a woman subjecting her to cruelty
E. Section 509: Word, gesture or act intended to insult the modesty of a woman.
