Procedure for registering a Trademark in India

Searching Trademark online: First, a thorough Trademark search needs to be done to decide whether your decided brand Logo pre-exists or not.
Classifying the TM: After searching in the portal, your TM has to be put into a specific classification. There are 45 classifications in total based on goods and services.
Filing Trademark Application: As per the procedure specified in the Act, the applicant is required to Draft an Application to file for TM registration.
Examination Report: An Examination Report is next issued within the time span of three months to one year. The time differs depending on the Back Log of the Registry.
Reply to examination report: A reply to the Examination Report needs to be filed within one month from the Receipt.
Advertisement in Indian Trademarks Journal: The application is advertised in the Trademarks Journal to invite Opposition from other users who might claim it to be theirs. If no Opposition is filed within four months of publication in the Trademark Journal, the application shall proceed to TM Registration.
