Supreme Court of India has Enhances Compensation for Maharashtra Farmers in 1994 Land Acquisition Case
01 Aug, 2025
In a regular bail plea filed in connection with an FIR under Sections 376, 354-C, 313, 323, and 506 IPC, the Delhi High Court, per Justice Girish Kathpalia, granted bail to a film director accused of rape, observing that the case exemplified a rising trend of false complaints in sexual offences.
The accused, arrested after rejection of his anticipatory and regular bail applications, approached the High Court asserting false implication by the complainant to pressure him for a role in films. He claimed a long-standing consensual live-in relationship with her.
In Sanoj Kumar Mishra v. State (NCT of Delhi), 2025, earlier anticipatory bail was denied based on allegations of rape, blackmail, and intoxication. However, in a statement recorded on 21-5-2025 under Section 180 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the complainant admitted to filing a false complaint under external provocation, naming several individuals involved. She also submitted an affidavit stating no objection to the accused’s release.
Taking note of these developments, the Court held there was no reason to continue depriving the accused of liberty and granted bail on a personal bond of Rs 10,000 with one surety. The Court strongly criticized false accusations, noting their societal damage, and stated such complaints must be sternly dealt with. It also recorded that the SHO had initiated proceedings to register an FIR against the complainant and others involved, with a supplementary charge sheet to follow.
Case title- Sanoj Kumar Mishra v. State (NCT of Delhi), Bail Appln. 1672 of 2025, decided on 30-5-2025.
