Supreme Court of India has Enhances Compensation for Maharashtra Farmers in 1994 Land Acquisition Case whose agricultural land was acquired in 1994 for establishing an industrial area. The apex court raised the amount from Rs- 32,000 per acre to Rs- 58,320 per acre, recognizing the prime location and market potential of the land.

A bench comprising Chief Justice B.R. Gavai and Justice Augustine George Masih delivered the ruling, overturning a Bombay High Court decision from April 2022, which had dismissed the farmers' appeals.

“We direct that the compensation granted to the appellants be enhanced from Rs- 32,000 per acre to Rs- 58,320 per acre,” the bench declared.

Legal Reasoning

The Court emphasized that the acquired land was situated in a prime industrial zone, entitling the farmers to compensation based on the highest bona fide sale exemplar of comparable property. This was consistent with established legal norms: when multiple sale deeds exist, the highest legitimate transaction should be factored in to ensure fair market value.

The bench noted that while it could have referred the matter back to the High Court for reassessment, honoring the appellants—who are farmers—directly and fairly determining compensation was appropriate given the long delay since acquisition in the early 1990s.

Case Background

The land in question was acquired under the Land Acquisition Act, 1894, for development of the Jintur industrial area in Parbhani district, Maharashtra. The Land Acquisition Officer initially awarded compensation in December 1994. The amount was contested, leading to reference proceedings and appeals which eventually reached the Bombay High Court. There, compensation was upheld at ?32,000 per acre, prompting further appeal to the Supreme Court.

Impact and Significance

This decision marks a landmark victory for landowners, particularly farmers who had received minimal compensation decades ago. It sends a clear message that compensation must reflect current land value and equitable market norms—even for long-ago acquisitions.

Legal experts say the case reinforces the principle that landowners cannot be disadvantaged by procedural delays or undervalued determinations. “The Supreme Court has upheld that fair compensation must be based on actual market intelligence and bona-fide transactions,” a senior advocate noted.

The Court's intervention bypasses prolonged High Court adjudication and evaluates the award directly, signaling its willingness to address justice delays impacting rural citizens.

What Happens Next

The Supreme Court has set aside the High Court order and remanded necessary adjustments based on updated valuation metrics. The State government and the Land Acquisition Collector will now revisit compensation payouts in light of the revised per-acre rate.

The judgment is expected to influence ongoing and future land acquisition cases, especially those involving rural communities impacted by antiquated compensation decisions.
