The Consumer Protection Bill, 2019 was introduced in Lok Sabha by the Minister of Consumer Affairs, Ram Vilas Paswan on July 8, 2019. The Bill replaces the Consumer Protection Act, 1986.
The definition of a consumer right is the ‘right to have information about different aspects of a good or service such as its quality, quantity, potency, purity, price and standard.’
Rights of consumers
- Consumer rights have been defined in the Bill, including the right to:
- Be protected against marketing of goods and services which are hazardous to life and property
- Be informed of the quality, quantity, potency, purity, standard and price of goods or services;
- Be assured of access to a variety of goods or services at competitive prices; and
- Seek redressal against unfair or restrictive trade practices.
Penalties for misleading advertisement
The CCPA may impose a penalty on a manufacturer or an endorser of up to Rs 10 lakh and imprisonment for up to two years for a false or misleading advertisement. In case of a subsequent offense, the fine may extend to Rs 50 lakh and imprisonment of up to five years.
Right to file a complaint from anywhere
According to this new right, consumers can now file a complaint with the District Consumer Commission or State Consumer Commission from anywhere, home, office or while on a weekend trip.
Right to seek compensation under product liability
Any complainant can file a case against the manufacturer or seller of a product for any loss caused to the complainant on account of a defective product, which applies to all services. If there is a manufacturing defect or the product in question does not conform to the express warranty the manufacturer or the seller will be held liable.

If one is unsatisfied with the order of the National Commission mentioned in the Revision Petition, then one can file a Special Leave Petition before the Supreme court, but it should fall under the limitation period mentioned in the Consumer Protection Act, i.e., within a period of thirty days.
If the person against whom the complaint is made, fails to comply with the decisions of the State or National Commission, then the person shall be liable for imprisonment for up to one month which may extend to three years.
