GST Issue to be legislated by Both State and Central Government

SC's Landmark Judgment: Both Centre & States Have Equal Powers to Legislate over GST

The Supreme Court ruled on Thursday that both the federal government and states have the authority to legislate on GST issues and that the GST Council's suggestions are simply persuasive rather than binding.

The subject issue being taxation, a bench led over by Justice D Y Chandrachud remarked that both the Centre and states have the right to create laws on it. The court emphasized the importance of the GST Council working together to reach a viable solution. 

Justice Chandrachud further added: "Recommendations of GST council are the product of collaborative discussion. It is not imperative that one of the federal units must always possess a higher share"
