A No Objection Certificate is a legal paper given by an organisation, institute, or individual stating that they have no objections to the information included in the document. It can be used to override any party's opposition in employment, commerce, litigation, immigration, and various other situations.

When is a NOC Issued?

In India, an employer, employee, landlord, tenant, or individual can give a NOC as a legal document. It can be used for:

• Making a deal
• A proposal
• Any type of business

This legal document might be used for or against you in a court of law. No Objection Certificates typically contain basic information on the parties involved and are delivered to whoever is interested.

A NOC is a necessary legal document for banking, immigration, automobile and housing registration, and job settings. The standard NOC format may be used for anything.

Application Procedure for NOC Offline

• The vehicle owner must travel to the local RTO to submit the NOC application.
• The completed CMV 28 form, as well as any other necessary documentation, must be submitted.
• The application for the NOC requires a cost of Rs.100.
• The RTO will obtain a vehicle report from the police authority after receiving the application to establish whether the vehicle is involved in any criminal proceedings or has been stolen.
• If there are no outstanding dues or DSA actions against the vehicle, a clearing receipt and a No Objection Certificate are issued.
• The RTO will issue the NOC Certificate in three business days.

Online Procedure for No Objection Certificate

The Parivahan site has made the process of applying for NOC easier. This portal provides online access to several Ministry of Road Transport and Highways' facilities, information, and services. The online NOC application process for automobiles is also included in the services.

However, there are certain states where the online NOC application is not yet available. As a result, you should validate if your state offers online NOC. Then take the following steps:

• Navigate to the Parivahan portal.
• Choose 'Vehicle-Related Services' from the 'Online Services menu.
• Choose the state in which the car is currently registered.
• Enter your vehicle's registration number, pick RTO, and then click 'Proceed'.
• Choose 'Application for NOC or No Objection Certificate' from the list of services.
• Enter your vehicle's chassis number (last five digits only).
• Enter the essential information and upload the appropriate documents.
• Pay the relevant fees using your favourite digital payment option.
• Keep your NOC application and acknowledgement slip safe.
• Print out the application and the acknowledgement receipt.
• Pay any outstanding road taxes to expedite the NOC approval procedure.
• Bring all relevant documentation, application forms, and the acceptance receipt to the RTO where your car is registered.

After you submit your application, RTO personnel will investigate the status of any outstanding dues or taxes on your vehicle.

Additionally, the officials will check the vehicle's ownership and guarantee that it has not been involved in any anti-social or criminal actions. The RTO will give you the NOC once you have completed the process.

If no problems arise during the verification, the entire procedure should take around three working days.

Documents Required to Obtain a NOC

• Certificate of registration (RC)
• Certificate of Insurance
• Permit and certificate of fitness (applicable for commercial vehicles)
• Certificate of Emission Testing (Pollution Under Control Certificate – PUC)
• Financier consent on CMV form 28 (if a Hypothecation, HPA, or lease arrangement covers the vehicle).
• For the CMV 28 form, pencil print the chassis number.
• Photo identification and proof of address

Validity of a No-Objection Certificate

A No-Objection Certificate is only valid for six months. Once the NOC has expired, you will be unable to provide it for re-registration. Within six months, you must submit the NOC and other relevant documentation to the local RTO of the state to which you are relocating.

The NOC is necessary when transporting a car from one state to another and selling a vehicle to someone who plans to take it to another state or union territory. In India, interstate automobile transfers might be a bit tricky. There are several organisations and automobile transportation companies that may provide you with further information.

Every state and union territory has a local RTO that regulates norms and manages car transfers. You are not obliged to file for an address change and re-registration if you travel to another state/UT for less than three months.
