What are the Trademark Considerations under Class 3?

Trademark is an important element in the sale of any goods and services. Without a proper trademark, one can not distinguish between different sellers. What is a Class 3 Trademark?

Trademarks under the National Institute for Health and Care Excellence are divided into 45 distinct classes under which all goods and services are classified. These classes are further divided into two sections based on whether it is goods or services. The Trademark Classes from 1-34 are applied to Goods and Classes 35-45are applicable for Services.

Class 3 Trademark is applicable primarily for the products dealing with cleaning and preparations. Under the umbrella of the Class 3 Trademark, one can count toiletries, Cosmetics, and beauty products. It mainly comprises cleaning preparations and toilet preparations.

Why are Trademark considerations for beauty brands?

Registering for a trademark is a lengthy process. It requires a lot of research before arriving at one decision. There are various elements that one has to consider while applying for a trademark registration process. One needs to know how to apply for a trademark under the law.

It helps in protecting the brand when the brand is trademarked. This is often avoided by people who want to keep the trade locally. 

  • One should always work with a trademark attorney in order to avoid mistakes that can cause problems later on. Having an attorney will provide the necessary legal insight that one might overlook in the process. It is highly recommended to have an attorney as it provides the legal support for the process that can sometimes get overwhelming. Research by the University of North Carolina reported that 50 percent of the cases with an attorney get easy approval.

  • One should also keep in mind while registering a company if they want to have an international customer base for their products. It thus becomes important to consider International Registration in trademarking to avoid confession. This provides international security to the brand from being copied or fraudulently marketed. A trademarked company can then take action accordingly if the brand is legally registered by international standards.

  • Once the registration is done, the court does not enforce the trademark. It is upon the owner to take the responsibility to enforce the brand in the market. This is very important as customer loyalty and brand reputation are everything in the beauty market. Thus a counterfeit product will become risky for the product in the market. To prevent such an occurrence one has to enforce their trademark to build the reputation.

The competition in the market and the demand for products has become a major factor in the counterfeit of products. It has become difficult to distinguish one product from another other than their trademark. Even in that, there have been cases of a slight change in the mark to confuse the buyers and thus sell fake products.

It has thus become important to trademark one's products and know-how to register your brand name trademark. A trademark will provide the security needed to sell a product freely in the market without the fear of being copied. And if someone does copy, the owner of the trademark has the legal right to file a case under the law.
