Trademark Hearing is an appearance before the Trademark registrar to plead your case on the removal of objection recorded by the authority. The applicant is then supposed to justify how the trademark matches the brand criteria and why the registrar should reconsider.

Trademark Hearing 

Once the Trademark Hearing date is issued, it is mandatory to appear in front of a Judge at the hearing. If not done so, this may lead to refusal of the Trademark Application. The applicant may go in person or have a Trademark Agent represent the case on his behalf.

Generally, an applicant is given three Trademark hearings to defend his Trademark application. If they fail to appeal, the case and the registration is rejected by the legal process.

Documents Required

1. Power of Attorney to be presented in favour of Trademark Attorney
    
2. A Letter of Authorization is needed, in case an Attorney is representing the TM hearing applicant
    
3. In an Affidavit of Usage, the applicant must give the complete details about the usage of the brand name to plead their case
    
4. Your Proof of Business is mandatory to support your claim
    
5. The earlier TM assessment report has to be brought forth
    
6. Lastly, the Hearing Notice should be included
