In an age of extreme competition in the market, there are various aspects that one needs to keep in mind before starting any business. Trademark is one of the most important aspects of identifying any business from one another. To help define one’s business identity there is a need to have a unique Trademark for the goods and services sold.

Every goods and service in the market falls under a certain Trademark Class Details .It is based on these classes that certain rules and regulations are set as standards for the sale of the products. Without this, it becomes to define the legal ground of any goods and services.

What is Trademark Class?

Trademark Registration in India under the Nice Classifications is divided into 45 distinct classes. It is under these that all goods and services are classified. Eash Trademark indicates a special category of goods and services.

These classes are subsequently divided into two major parts based on the category of Goods and the category of Services. The Trademark Classes from 1-34 are applied for all products that fall under the umbrella term of Goods. Classes 35-45 are on the other hand applicable for all products related to the category of Services. for Services.

Apart from these, there are cases where the products do not just limit to one class and are thus also applicable to other Trademark Class products. These are known as the Coordinated Class products.

Classification of Trademark Classes

One can opt for the Trademark Class finder tool in order to find the perfect class of trademark for products they deal in. The Trademark Class is divided into two major categories. They are:

  1. Classes for Goods

  2. Classes for Services

Classes in the Goods Section

  1. Class 1- Chemicals which are used in industry, photography, forestry, unprocessed artificial resins, Tanning and adhesive substances etc.

  2. Class 2- Paints; varnishes; preservatives against rust and against deterioration of wood; colorants; metals in foil and powder form for painters; decorators; printers and artists;

  3. Class 3- Cleaning products, cosmetics, bleach and abrasives, laundry products, essential oils etc.

  4. Class 4- Industrial oils and greases; lubricants; dust absorbing, wetting and binding compositions; fuels (including motor spirit) and illuminants; candles, wicks;

  5. Class 5- Pharmaceuticals, veterinary products, dietetic, dental wax, disinfectants, herbicides, fungicides etc.

  6. Class 6- Metal castings, hardware, locks and safes, common metal and their alloys, building material (metal), other metals are not included in any other class etc.

  7. Class 7- Machines and machine tools; machine coupling and transmission components; agricultural implements other than hand-operated; incubators for eggs;

  8. Class 8- Implements and hand tools, cutlery and razors etc

  9. Class 9- Scientific, electric, photographical, measuring, apparatus for recording, transmission or reproduction of sound or images; data processing equipment and computers;

  10. Class 10- Surgical, medical, dental and veterinary apparatus and instruments, artificial limbs, eyes and teeth; orthopedic articles; suture materials;

  11. Class 11- Apparatus for lighting, heating, steam generating, cooking, refrigerating, drying ventilating, water supply and sanitary purposes

  12. Class 12- Apparatus for locomotion by land, water, and air.

  13. Class 13- Ammunition, firearms, explosives, fireworks etc.

  14. Class 14- Precious metals and their alloys and goods in precious metals; jewellery, precious stones; horological and other chronometric instruments

  15. Class 15- Musical instruments

  16. Class 16- Paper, cardboard and goods made from these materials; printed matter; stationery; brushes; typewriters and office requisites; plastic materials for packaging;

  17. Class 17- Rubber, asbestos, mica and goods made from these materials; plastics in extruded form for use in manufacture; packing, stopping and insulating materials; flexible pipes;

  18. Class 18- Leather and imitations of leather, and articles which are made from these items and not included in other classes, animal skins, and hides etc.

  19. Class 19- Building materials, (non-metallic), non-metallic rigid pipes for building; asphalt, pitch and bitumen; non-metallic transportable buildings; monuments, not of metal.

  20. Class 20- Furniture, mirrors, picture frames; goods of wood, cork, reed, cane, wicker, horn, bone, ivory, whalebone, shell, amber, mother-of-pearl, meerschaum, or of plastics

  21. Class 21- Household or kitchen utensils and containers; combs and sponges; articles for cleaning purposes; unworked or semi-worked glass; glassware and earthenware;

  22. Class 22- Ropes, string, nets, tents, awnings, tarpaulins, sails, sacks and bags, padding and stuffing materials(except of rubber or plastics); raw fibrous textile materials

  23. Class 23- Yams and threads for textile uses.

  24. Class 24- Textiles and textile goods, not included in other classes; bed and table covers.

  25. Class 25– Clothing, footwear, headgear.

  26. Class 26- Lace and embroidery, ribbons and braid; buttons, hooks and eyes, pins and needles; artificial flowers.

  27. Class 27- Carpets, rugs, mats and matting, linoleum and other materials for covering existing floors; wall hangings(non-textile).

  28. Class 28- Games and playthings, gymnastic and sporting articles not included in other classes; decorations for Christmas trees.

  29. Class 29- Meat, fish, poultry and game; meat extracts; preserved, dried and cooked fruits and vegetables; jams, fruit sauces; eggs, milk and milk products; edible oils and fats.

  30. Class 30- Coffee, tea, cocoa, sugar, rice, tapioca, sago; bread, pastry and confectionery, ices; honey, treacle; yeast, baking powder; salt, mustard; vinegar; spices; ice.

  31. Class 31- Agricultural, horticultural and forestry products and grains; live animals; fresh fruits and vegetables; seeds, natural plants and flowers; foodstuffs for animals, malt.

  32. Class 32- Beers, mineral and aerated waters, and other non-alcoholic drinks; fruit drinks and fruit juices; syrups and other preparations for making beverages.

  33. Class 33- All alcoholic beverages (excluding beer).

  34. Class 34- Matches, smoker’s articles, tobacco.

The Classes under the category of Services are:

  1. Class 35- Advertising and Business In this class, services that help the management in managing the affairs, the organization (commercial organization) are included. Any advertising activity in which an announcement is made to the general public at large or concerns any type of goods and services are included.

  2. Class 36- Insurance and Financial In this class, activities relating to insurance, the finance sector, or the monetary sector are included.

  3. Class 37- Construction and Repair In this class, the work done by contractors, subcontractors, in the making or repairing work of buildings, or any restoration of work to its original state is included.

  4. Class 38- Communication In this class, services that help in communicating anything between people are covered, whether oral or visual.

  5. Class 39- Transportation and storage in this class, any service related to storage of goods in a warehouse or any other place or transporting them from one place to another is included. The transportation can be via land, air or water.

  6. Class 40– Material treatment in this class, any service which involves changing of a chemical or the mechanical composition of a substance is included. Or any other service not included in any other class on the same lines.

  7. Class 41- Education and Entertainment In this class, any service which improves the knowledge or mental capacity of a person or animal is included. It also includes services that entertain people or animals.

  8. Class 42- Scientific, design, and technical services; industrial analysis and research services; design and development of computer hardware and software.

  9. Class 43- Services for providing food and drink; temporary accommodation.

  10. Class 44- Medical services, veterinary services, hygienic and beauty care for human beings or animals; agriculture, horticulture and forestry services.

  11. Class 45– Legal services; security services for the protection of property and individuals; personal and social services rendered by others to meet the needs of individuals.
