Delhi High Court Directs Mandatory Biometric Aadhaar Authentication for GST Registration

A Division Bench of Hon’ble Justice Shail Jain and Justice Anil Kshetarpal of the Hon’ble Delhi High Court, in Neha v. Union of India & Ors 2026 with W.P.(C) 12210/2026 forming one of the petitions has passed an interim order making biometric Aadhaar authentication mandatory for GST registration.

The matter arose from a writ petition concerning fraudulent GST registrations allegedly obtained using the petitioner’s PAN and Aadhaar details. The petitioner informed the Hon’ble High Court of Delhi that her PAN and Aadhaar details were allegedly misused to obtain fraudulent GST registrations, resulting in an alleged liability of over Rs 4.46 crore involving her bank account. The petitioner further added that she approached GST authorities in March 2026, but alleged that no effective action was taken by the concerned authorities. This prompted her to move to the Delhi High Court.

The Court expressed serious concern over fraudulent GST registrations using PAN and Aadhaar details. Additionally, the court added, “It has created more problems than it solved.”  The Court expressed concern that such fraudulent registrations undermine the GST framework and cause hardship to affected individuals. Consequently, the court directed the concerned authorities “...not to allow any GST Registration without biometric based AADHAAR authentication henceforth.”

The direction is interim, and the matter is listed for further hearing on 22 September 2026.
